Hearing on the appeals filed by Sajal Deb and Manoj Kumar Debbarma on behalf of the contractual teachers employed under Sarva Siksha Abhiyan demanding regularization has been deferred today.
A Division Bench of High Court of Tripura comprising Chief Justice Sanjay Karol and Justice Arindam Lodh posted the case for hearing after Durga Puja. Earlier, a Single Bench of High Court of Tripura headed by Justice Lodh heard both the petitions and referred the matter for further hearing to a Division Bench.
The next hearing will take place on November 11.
The regularization of teachers under Sarva Siksha Abhiyan does not seem to be a matter of concern for state government as they have been working on a contractual basis for many years. “The SSA teachers were not appointed on regular basis by the then Left Front government. It was a gross violation of the norms of SSA and Right to Education (RTE) Act, 2009”, according to SSA teachers. The posts of teachers sanctioned under the SSA were regular and the mandatory norms of SSA framed by MHRD said, the posts should have been created by states in Education Department with same salary, allowances and service conditions as of regular teachers. “As per the NCTE notification (amended) in 2011, teachers appointed before 2010-11 are exempted from clearing the TET exams as per the Para 5 of the notification”, the SSA teachers added.
Moreover, central government provides 90 per cent of the funding while the state government provides 10 per cent as a pre condition to appoint the teachers on a regular basis. Earlier, teachers and non-teaching staffers working under Sarva Shiksha Abhiyan launched fast unto death agitation in the capital demanding regularisation of their service.
