SC to hear contempt to court case over 10, 323 teacher dismissal case on Oct 24

AGARTALA:

The Supreme Court under the division bench of Supreme Court comprising Justices Adarsh Kumar Goel and Udai Umesh Lalit on Wednesday postponed the hearing of contempt to court case against the Tripura government over 10, 323 teacher dismissal case on October 24 next.

The apex court stayed issuance of any appointment till October 24’ after the state government’s affidavit, replying to the notice, had come up for hearing today.

Debasish Paul Chowdhury of Charilam area under Bishalgarh subdivision had filed a case alleging violation of the Supreme Court order and alleged that the state government has violated the apex court direction while formulating recruitment rules for all the newly created posts where teaching experience was made mandatory, which the petitioner felt an attempt by the govt to accommodate sacked teachers.

However, from the government’s end it has been claimed that there had been no violation of the apex court order on the dismissal and the state had a right under Article 309 of the constitution to create posts and recruit new incumbents as per requirements.
